Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Vesper mobile application, website, and related services (together, the "Service"), provided by Vesper ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. Please read them carefully.

1. Eligibility

You must be at least 18 years old to use the Service. By creating an account or otherwise using the Service, you represent that you meet this age requirement. We will close any account we discover belongs to a person under 18.

2. Your Account

You are responsible for keeping your account credentials safe and for all activity that happens under your account. Notify us immediately via our contact form if you suspect unauthorized access.

3. Subscriptions and Payments

3.1 Plans

Vesper offers a free plan and paid Premium plans (currently $1.99 per month and $25 per year, subject to local taxes and store conversion). Pricing may change; we will give reasonable notice before a price increase affects your renewal.

3.2 Billing

Premium subscriptions are billed by the App Store or Google Play according to their terms. Subscriptions renew automatically until you cancel. To cancel, manage your subscription in your App Store or Google Play account.

3.3 Refunds

Refund requests for store-billed subscriptions are handled by Apple or Google according to their respective refund policies. We are not able to issue refunds directly for purchases made through those stores.

4. Acceptable Use

You agree not to:

• Use the Service in violation of any law or regulation.
• Reverse engineer, scrape, or attempt to disrupt the Service.
• Use the Service to harass, threaten, or harm any other person.
• Submit content that is illegal, infringing, or obscene.
• Resell or sublicense access to the Service.

5. Astro AI and Content

Astro AI generates personalized text in response to your prompts and chart data. You are responsible for how you act on that text. AI output may occasionally be inaccurate or incomplete. The Service is for reflection and entertainment, not professional advice.

Content you create or save inside the Service remains yours. By using the Service, you grant us a limited, non-exclusive license to host and display that content to you on your devices, solely so we can operate the Service.

6. Intellectual Property

All software, designs, text, graphics, and other materials produced by Vesper are protected by copyright and other intellectual property laws. We grant you a personal, non-transferable, non-exclusive license to use the Service for your own personal, non-commercial purposes. All other rights are reserved.

7. Third-Party Services

The Service relies on third parties for billing, hosting, and certain features. Their terms and privacy practices apply when you use those parts of the Service. We are not responsible for third-party content or actions.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ASTROLOGICAL READINGS AND AI-GENERATED CONTENT ARE OFFERED FOR PERSONAL REFLECTION AND ENTERTAINMENT, AND ARE NOT PROFESSIONAL MEDICAL, LEGAL, OR FINANCIAL ADVICE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VESPER AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE LIABILITY.

10. Termination

You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that risks harm to other users or to the Service itself. Upon termination, sections of these Terms that by their nature should survive will continue to apply.

11. Changes to the Service or Terms

We may update the Service and these Terms over time. If we make material changes, we will give reasonable notice in the app or by email. Your continued use of the Service after the changes take effect means you accept the updated Terms.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which Vesper is operated, without regard to its conflict of law principles. Where local consumer protection law gives you stronger rights, those rights apply.
